ÖZ

Araştırmamızın konusunu, fikri mülkiyet hukukuna göre mimarlık eserleri oluşturmaktadır. Çalışmamız kapsamında fikri mülkiyet hukukunda mimarlık eserleri, mimarlık eserlerindeki eser türü ayrımı ve çerçevesinde mimarlık eserlerinde menfaatin dengelenmesi ve bu yolla ne tür değişiklikler yapılabileceği incelenmiştir. Araştırma dâhilinde, ilim ve edebiyat eseri ile güzel sanat eseri niteliğindeki mimarlık eserleri ve farkları, mimarlık eseri üzerinde doğan fikri mülkiyet hakları ile mülkiyet hakkı ve mimarlık eseri yapıda menfaatlerin ne şekilde dengeleneceği doktrindeki görüşler, uygulamadaki ihtilaflar, Yargıtay kararları ve yabancı hukuklardaki düzenlemeler eşliğinde ayrıntılı şekilde ele alınacaktır. Çalışmamızda mimarlık eserlerin özellik arz eden yönlerinin incelenmesi amaçlanmıştır. Araştırma kapsamında hedeflenen amaç, fikri mülkiyet hukukuna göre mimarlık eserlerini ve eserde değişiklik yapılmasının mimarlık eserlerine özgü uygulamasını incelemektir.

ABSTRACT

The subject of this project/thesis/research is the within the context of intellectual property rights and more specifically the intellectual property rights on architectural works and collision of interest of parties as far as the intellectual rights and rights of property of the

holder to the work are concerned will be discussed. The interests and rights of owner of the property as being the architectural object and the moral rights of the architect; balance, collision and controversies between these right holders will be scrutinized and discussed under the light of the current issues and decisions issued in Turkey and abroad. The scope of the architectural Works is aimed to examine with all characteristics aspects in the thesis. The focus will be on the discussion of the modifications made in the architectural Works by the holder of the right on property.
